20 Section 1. Section 40.1, Code 2001, is amended by striking
30 the section and inserting in lieu thereof the following:
40 40.1 CONGRESSIONAL DISTRICTS.
50 The state of Iowa is hereby organized and divided into five
60 congressional districts, which shall be composed,
70 respectively, of the following counties:
80 1. The first district shall consist of the counties of
90 Butler, Bremer, Fayette, Clayton, Black Hawk, Buchanan,
100 Delaware, Dubuque, Jones, Jackson, Clinton, and Scott.
110 2. The second district shall consist of the counties of
120 Linn, Johnson, Cedar, Washington, Louisa, Muscatine, Wapello,
130 Jefferson, Henry, Des Moines, Wayne, Appanoose, Davis, Van
140 Buren, and Lee.
150 3. The third district shall consist of the counties of
160 Grundy, Tama, Benton, Polk, Jasper, Poweshiek, Iowa, Marion,
170 Mahaska, Keokuk, Lucas, and Monroe.
180 4. The fourth district shall consist of the counties of
190 Emmet, Kossuth, Winnebago, Worth, Mitchell, Howard,
200 Winneshiek, Allamakee, Palo Alto, Hancock, Cerro Gordo, Floyd,
210 Chickasaw, Pocahontas, Humboldt, Wright, Franklin, Calhoun,
220 Webster, Hamilton, Hardin, Greene, Boone, Story, Marshall,

240 5. The fifth district shall consist of the counties of

1530 b. In Sioux county, Capel, Eagle, Garfield, Lincoln,
1540 Settlers, Sheridan, Sioux, Welcome, West Branch, Center,
1550 Plato, and Rock townships, and that portion of Holland
1560 township lying outside the corporate limits of the city of
1570 Orange City.
1580 5. The fifth representative district shall consist of:
1590 a. Osceola county.
1600 b. O'Brien county.
1610 c. In Sioux county, East Orange, Floyd, Grant, and Lynn
1620 townships.
1630 d. In Clay county, Clay, Douglas, Garfield, Herdland,
1640 Lincoln, Logan, Lone Tree, Peterson, Riverton, Summit,

1660 6. The sixth representative district shall consist of:

1700 (2) Freeman, Lake, Meadow, and Sioux townships.
1710 7. The seventh representative district shall consist of:
1720 a. Emmet county.
1730 b. Palo Alto county.
1740 c. In Kossuth county:
1750 (1) The cities of Wesley and West Bend.
1760 (2) Buffalo, Burt, Eagle, German, Grant, Greenwood,
1770 Harrison, Hebron, Lincoln, Lotts Creek, Portland, Ramsey,
1780 Seneca, Springfield, Swea, Wesley, Fenton, Ledyard, and Plum
1790 Creek townships.
1800 (3) That portion of Union township bounded by a line
1810 commencing at the point the east boundary of Union township
1820 intersects the north corporate limit of the city of Algona,
1830 then proceeding first north, and then in a counterclockwise
1840 manner along the boundary of Union township until it
1850 intersects the west corporate limit of the city of Algona and
1860 the east boundary of Cresco township, then proceeding first
1870 north, and then in a clockwise manner along the corporate
1880 limits of the city of Algona to the point of origin.
1890 8. The eighth representative district shall consist of:
1900 a. Humboldt county.
1910 b. Pocahontas county.
1920 c. In Kossuth county:
1930 (1) The city of Algona.
1940 (2) Irvington, Luverne, Riverdale, Sherman, Whittemore,
1950 and Cresco townships, that portion of Garfield township lying

1990 contained in the seventh representative district.
2000 d. In Webster county, Deer Creek, Jackson, and Johnson
2010 townships.
2020 9. The ninth representative district shall consist of:
2030 a. The city of Dows.
2040 b. Wright county.
2050 c. In Hamilton county:
2060 (1) The city of Webster City.
2070 (2) Blairsburg, Cass, Clear Lake, Freedom, Fremont,
2080 Hamilton, Independence, Marion, Webster, and Williams
2090 townships.
2100 d. In Webster county, Hardin, Pleasant Valley, Sumner,
2110 Webster, and Yell townships, and that portion of Washington
2120 township lying outside the corporate limits of the city of
2130 Duncombe.
2140 10. The tenth representative district shall consist of:
2150 a. In Story county:
2160 (1) The city of Kelley.
2170 (2) Collins, Howard, Indian Creek, Lafayette, Lincoln,
2180 Milford, Nevada, New Albany, Palestine, Richland, Sherman,
2190 Union, and Warren townships, and that portion of Grant
2200 township not contained in the forty-fifth representative
2210 district.
2220 c. In Hamilton county, Ellsworth, Lincoln, Lyon, Rose
2230 Grove, Scott, and Liberty townships.
2240 11. The eleventh representative district shall consist of:
2250 a. Winnebago county.
2260 b. Worth county.
2270 c. In Hancock county:
2280 (1) The city of Garner.
2290 (2) Bingham, Boone, Britt, Concord, Crystal, Ellington,
2300 Erin, Garfield, Madison, Magor, and Orthel townships.
2310 12. The twelfth representative district shall consist of:
2320 a. In Cerro Gordo county:
2330 (1) The city of Clear Lake.
2340 (2) Bath, Clear Lake, Dougherty, Falls, Geneseo, Grant,
2350 Grimes, Lake, Lime Creek, Lincoln, Mount Vernon, Pleasant
2360 Valley, and Union townships.
2370 b. In Franklin county:
2380 (1) The cities of Hampton and Sheffield.
2390 (2) Geneva, Grant, Hamilton, Ingham, Lee, Marion, Mott,
2400 Oakland, Reeve, Richland, Ross, Scott, West Fork, and Wisner
2410 townships, that portion of Morgan township lying outside the
2420 corporate limits of the city of Dows, and that portion of
2430 Osceola township not contained in the forty-fourth
2440 representative district.
2450 c. In Hancock county, Amsterdam, Avery, Liberty, and Twin
2460 Lake townships, and that portion of Ell township lying outside
2470 the corporate limits of the city of Garner.
2480 13. The thirteenth representative district in Cerro Gordo
2490 county shall consist of:
2500 a. The city of Mason City.
2510 b. That portion of Mason township lying north of the
2520 corporate limits of the city of Mason City.
2530 14. The fourteenth representative district shall consist

2690 16. The sixteenth representative district shall consist

2710 a. Allamakee county.
2720 b. In Winneshiek county, Bloomfield, Bluffton, Burr Oak,
2730 Canoe, Decorah, Frankville, Glenwood, Hesper, Highland,
2740 Pleasant, and Springfield townships.
2750 17. The seventeenth representative district shall consist

2930 (2) Franklin, Frederika, Fremont, Le Roy, Maxfield,

2950 d. In Fayette county:
2960 (1) The city of West Union.
2970 (2) Auburn, Banks, Bethel, Center, Clermont, Dover, Eden,
2980 Fremont, Harlan, Jefferson, Windsor, and Union townships, and
2990 that portion of Oran township lying outside the corporate

3010 19. The nineteenth representative district in Black Hawk
3020 county shall consist of:

4330 east, and then in a clockwise manner along the corporate
4340 limits of the city of Waterloo until it intersects the Cedar
4350 river, then proceeding northwesterly along the Cedar river
4360 until it intersects West Conger street, then proceeding
4370 southwesterly along West Conger street until it intersects
4380 Ansborough avenue, then proceeding southwesterly along
4390 Ansborough avenue until it intersects Maynard avenue, then

4570 then in a clockwise manner along the boundary of Poyner
4580 township until it intersects Gilbertville road, then
4590 proceeding southeasterly along Gilbertville road until it
4600 intersects Indian Creek road, then proceeding southeasterly,
4610 then east, along Indian Creek road to the point of origin.
4620 24. The twenty-fourth representative district shall
4630 consist of:
4640 a. Clayton county.
4650 b. In Delaware county:

4670 (2) Coffins Grove, Elk, Honey Creek, Oneida, and Richland
4680 townships, and that portion of Delaware township lying outside
4690 the corporate limits of the city of Manchester.

4720 (2) Fairfield, Illyria, Pleasant Valley, Putnam, Scott,
4730 Smithfield, and Westfield townships.
4740 25. The twenty-fifth representative district shall consist

27090 Sec. 3. MEMBERSHIP.
27100 1. CONGRESSIONAL DISTRICTS. Each congressional district
27110 established by section 1 of this Act shall elect one
27120 representative for a term of two years in 2002 and every
27130 subsequent even-numbered year.
27140 2. STATE SENATE AND HOUSE DISTRICTS. The membership of
27150 the senate and house of representatives in the eightieth and
27160 subsequent general assemblies shall be determined as follows:
27170 a. Each representative district established by section 2
27180 of this Act shall elect one representative for a term of two
27190 years in 2002 and every subsequent even-numbered year.
27200 b. Each odd-numbered senatorial district established by
27210 section 41.2 which the general assembly adopts by reference,
27220 and section 2 of this Act, shall elect a senator in 2002 for a
27230 four-year term commencing in January 2003. If an incumbent
27240 senator who was elected to a four-year term which commenced in
27250 January 2001, or was subsequently elected to fill a vacancy in
27260 such a term, is residing in an odd-numbered senatorial
27270 district on February 1, 2002, that senator's term of office
27280 shall be terminated on January 1, 2003.
27290 c. Each even-numbered senatorial district established by
27300 section 41.2 which the general assembly adopts by reference,
27310 and section 2 of this Act, shall elect a senator in 2004 for a
27320 four-year term commencing in January 2005.
27330 (1) If one and only one incumbent state senator is
27340 residing in an even-numbered senatorial district on February
27350 1, 2002, and that senator meets all of the following
27360 requirements, the senator shall represent the district in the
27370 senate for the Eightieth General Assembly:
27380 (a) The senator was elected to a four-year term which
27390 commenced in January 2001 or was subsequently elected to fill
27400 a vacancy in such a term.
27410 (b) The senatorial district in the plan which includes the
27420 place of residence of the state senator on the date of the
27430 senator's last election to the senate is the same as the even-
27440 numbered senatorial district in which the senator resides on
27450 February 1, 2002, or is contiguous to such even-numbered
27460 senatorial district and the senator's declared residence as of
27470 February 1, 2002, was within the district from which the
27480 senator was last elected. Areas which meet only at the points
27490 of adjoining corners are not contiguous.
27500 (2) Each even-numbered senatorial district to which
27510 subparagraph (1) of this paragraph "c" is not applicable shall
27520 elect a senator in 2002 for a two-year term commencing in
27530 January 2003. However, if more than one incumbent state
27540 senator is residing in an even-numbered senatorial district on
27550 February 1, 2002, and, on or before February 15, 2002, all but
27560 one of the incumbent senators resigns from office effective no
27570 later than January 1, 2003, the remaining incumbent senator
27580 shall represent the district in the senate for the Eightieth
27590 General Assembly. A copy of the resignation must be filed in
27600 the office of the secretary of state no later than five p.m.
27610 on February 15, 2002.
27620 d. To fulfill the purposes of this subsection, the
27630 secretary of state shall prescribe a form to be completed by
27640 all senators to declare their residences as of February 1,
27650 2002. The form shall be filed with the secretary of state no
27660 later than five p.m. on February 1, 2002.
27670 Sec. 4. VACANCIES.
27680 1. MEMBER OF CONGRESS. If a special election to fill a
27690 vacancy for a representative in Congress occurs or exists
27700 after the effective date of this Act, at a time which makes it
27710 necessary to fill the vacancy at a special election held
27720 pursuant to section 69.14, the vacancy shall be filled from
27730 the same district provided in chapter 40, Code 2001, which
27740 elected the representative whose seat is vacant. This section
27750 does not apply if a special election is not required under
27760 section 69.14.
27770 2. MEMBER OF GENERAL ASSEMBLY. If a vacancy in the
27780 general assembly occurs or exists after the effective date of
27790 this Act, at a time which makes it necessary to fill the
27800 vacancy at a special election held pursuant to section 69.14,
27810 the vacancy shall be filled from the same district provided in
27820 chapter 41, Code 2001, which elected the senator or
27830 representative whose seat is vacant. This section does not
27840 apply if a special election is not required under section
27850 69.14.
27860 3. REPEAL. This section is repealed January 1, 2003.
27870 Sec. 5. GEOGRAPHY. For purposes of this Act, each
27880 reference to a specific city or township means the city or
27890 township as its boundary existed on January 1, 2000, the
27900 official date for establishing such boundaries under the 2000
27910 United States decennial census. Also, for purposes of this
27920 Act, such reference to a street or other boundary means such
27930 street or boundary as they are delineated on the official
27940 Public Law 94-171 census maps.
27950 Sec. 6. EFFECTIVE DATE. This Act, being deemed of
27960 immediate importance, takes effect upon enactment.

28000 This bill establishes congressional and legislative
28010 districts for the state effective during the 2002 and
28020 subsequent general elections. Current Code section 41.2
28030 provides that state senate districts are composed of two state
28040 representative districts and specifies which numbered
28050 representative districts make up each numbered senate
28060 district. The bill takes effect upon enactment.
